Terms of Service

These terms cover your use of this website, which is operated by J KISS LLC under the name Sites by Nu. By using the site you agree to them.
They are not the contract for a project. Work we do for a client is governed by the invoice and the service agreement for that project, which the client reviews and accepts before work begins. If those documents and this page ever disagree, the invoice and the service agreement win.
1.Using this site
You may browse the site, read the case studies and contact us. You agree not to misuse it: do not try to break into it, overload it, scrape it in bulk, interfere with how it works for others, or use it for anything unlawful.
2.What is shown here
The case studies describe real work. Each one is labeled with how it came about — client work, our own venture, or a demonstration build. They show what was built, not a promise that your project will produce a particular result.
The text, design and code of this site belong to J KISS LLC. The names, logos and screenshots of the businesses shown belong to their owners and appear here to describe the work done for them. Please do not copy the site's content for your own commercial use without asking.
3.Inquiries and quotes
Sending an inquiry does not create a contract, and it does not oblige either of us to go ahead. Any price or timeline we give you in reply is an estimate until it is set out on an invoice and, where one is used, a service agreement that you have accepted.
Please make sure what you send us is accurate and is yours to share.
4.Invoices and agreements
Invoices, service agreements and reports are shared through private links. A link is meant for you and the people you choose to share it with; anyone who has it can open the document.
When you type your name and accept an invoice or a service agreement online, that has the same effect as signing it by hand. We record your name, the email address you give, the date and time, and the version of the document you accepted, and a copy stays available to you at the same link.
5.Payment
The amount due, the due date and the ways you can pay are stated on each invoice. Where a payment plan is offered and you choose it, the schedule you accepted is the schedule that applies. Late-payment terms, where they apply, are stated on the invoice or in the service agreement.
Some invoices can be paid online by card. Card payments are processed by Stripe, and your card details are entered with Stripe, not with us.
If a surcharge applies to credit card payments, the surcharge and the total that will be charged are shown to you before you confirm the payment, and you can choose another way to pay instead. Debit cards and prepaid cards are not surcharged. The other payment methods listed on your invoice carry no fee from us.
Refunds, where they are due, are made as set out in the service agreement for the project. A refund of a card payment is returned to the card it was paid with.
6.Text messages
If you agree to receive text messages from us, we will text you about your own invoices — when one is ready, updated or overdue. Message frequency varies. Message and data rates may apply. Reply STOP to stop at any time, or HELP for help. Agreeing to texts is not a condition of buying anything from us.
Carriers are not responsible for delayed or undelivered messages.
7.Other services
The site links to other websites, including the live sites of the businesses shown in the case studies, and uses outside services such as Stripe to take payments. We are not responsible for the content or practices of sites and services we do not run; their own terms and privacy policies apply to them.
8.No warranties
This website is provided as it is. We work to keep it accurate and available, but we do not promise that it will always be available, free of errors or suitable for a particular purpose. Nothing on it is professional advice for your specific situation.
This section is about the website. What we commit to for a client's project is set out in that project's service agreement.
9.Limit of liability
To the extent the law allows, J KISS LLC is not liable for indirect, incidental or consequential losses arising from your use of this website, and our total liability for any claim arising from your use of the website is limited to one hundred US dollars. This does not limit liability that cannot be limited by law, and it does not change what a client is entitled to under a service agreement.
10.Governing law
These terms are governed by the laws of the State of Texas, without regard to its conflict-of-laws rules. Any dispute about them will be brought in the state or federal courts located in Texas.
11.Changes to these terms
We may update these terms. When we do, the date at the top of this page changes. Changes do not alter an invoice or a service agreement you have already accepted.
